An accident lawyer contacted by the family would need to do a thorough investigation. Like any good accident lawyer knows, a large part of the case is decided early on, when the facts are fresh and capable of being investigated. For example, I would want to interview any eyewitnesses, get photos of the car and of the scene, and possibly look at the scene myself. If the driver of the SUV is not represented, I might try to speak with him or her, and actually take a statement, as long as they know what my interests are. I would want to explore the speed the driver was going, and when he first noticed the pedestrian.
